My fiance was caught carry a hand gun but he hand the clip in another pocket, he was stopped by the police?

he was walking from the gas station at around 11pm. They stopped him because they said he fit the description of a suspect that had robbed a woman for her car(he doesn't even have a dl and he can't drive AT ALL) and they also said committed home invasion. He had be gone from our apt maybe 40Min's and he called me from the gas station. He was arrested and let go of the robbery and invasion charge because the victim stated it wasn't him in a line up.He was charged with ccw which is a felony. He doesn't have a record and he has never been to jail a day in his. we live in ohio but were from detroit so he was looking at it like he was protecting himself because that's what we would have to do back home. I saw the police report and it stated the gun was loaded. but the clip was in his pocket. what is his chances of going to jail. Is it possible for him to get parole and just be on probation. We have a court appointed lawyer.
