Agree or Disagree: Is robbery with a firearm pre-meditated murder?

Disagree, but not completely. In my area, there is a difference in sentencing between a robbery and an armed robbery. The difference being if a firearm or other weapon was used, or threatened to be used, by the robber. The fact of a weapon being involved automatically adds a minimum 5 years to any sentence. If anyone dies, a law enforcement officer, victim, or innocent bystander, because of the use of the weapon, the crime changes to first degree murder, punishable by death or life in prison with no chance of parole. Accidental weapons discharge, malfunction, or lack of intent does not mitigate the sentence.
